The biggest financial distinction between off-plan and resale properties in Spain comes down to tax treatment. New-build properties (including off-plan purchases) attract 10% IVA (VAT) plus 1.2% AJD (stamp duty), whilst resale properties face 7% ITP (transfer tax) in Andalucía.
For a €400,000 purchase, this translates to €44,800 in taxes on a new-build versus €28,000 on a resale property. That €16,800 difference often determines which route makes financial sense, particularly for buyers stretching their budget.
The tax calculation gets more complex with off-plan purchases because you pay IVA on the land value when you sign the initial contract, then on the construction value at completion. Your Spanish property lawyer will structure the payments to spread this liability across the build timeline.
Mortgage Lending: Stricter Rules for Off-Plan
Spanish banks treat off-plan and resale properties differently when assessing mortgage applications. For resale properties, non-resident buyers typically access 60-70% LTV mortgages from BBVA, Sabadell, or CaixaBank, with the bank valuing the completed property.
Off-plan mortgages face additional scrutiny. Banks want to see the developer’s financial guarantees, building permits, and completion timeline before approving finance. Many lenders cap off-plan LTVs at 60% for non-residents, compared to 70% for equivalent resale properties.
Consider a UK couple earning £80,000 annually, looking at a €450,000 off-plan apartment in Estepona. With a 60% LTV, they would need €180,000 upfront (40% deposit plus taxes and fees), compared to €157,500 for a similar resale property at 65% LTV. The monthly payment on a €270,000 mortgage at current rates (around 4.5%) would be approximately €1,500 over 25 years.
Completion Timelines and Risks
Resale properties offer immediate occupancy once the escritura is signed and registered, typically 8-12 weeks after agreeing terms. You can view the finished property, assess any defects, and move in straight away.
Off-plan developments carry construction delays and specification changes. Spanish law requires developers to provide bank guarantees covering buyer deposits, but completion can stretch 18-36 months beyond the original timeline. During this period, you cannot generate rental income or use the property personally.
The risk-reward calculation varies by buyer profile. Retirees wanting immediate access to their Spanish home typically favour resale properties, whilst investors comfortable with longer timelines may prefer off-plan developments in emerging areas like Estepona’s New Golden Mile.
Build Quality and Customisation
New-build properties comply with current Spanish building regulations, including improved insulation standards and energy efficiency ratings. Most off-plan developments on the Costa del Sol target A or B energy certificates, reducing ongoing utility costs.
Off-plan buyers often get customisation options during construction – choosing kitchen finishes, bathroom tiles, or internal layouts before completion. This personalisation comes at a premium but can add significant value in competitive rental markets.
Resale properties, particularly those built before 2006, may require updates to meet modern standards. Factor €15,000-30,000 for kitchen and bathroom renovations, plus potential costs for improved insulation or air conditioning systems.
Location and Availability
Prime beachfront locations in established areas like Puerto Banús or Marbella’s Golden Mile rarely have new-build opportunities. Most off-plan developments sit in expanding areas like Estepona, Benahavís, or inland Mijas, where land remains available.
Resale properties offer immediate access to mature communities with established amenities, schools, and transport links. You can assess the neighbourhood, noise levels, and local services before committing.
Off-plan developments promise future amenities – communal pools, gyms, or commercial spaces – but these may not materialise exactly as marketed. Always review the developer’s track record and visit their completed projects before signing contracts.
Investment Considerations
Off-plan properties typically offer below-market pricing during pre-launch phases, with potential capital appreciation by completion. However, this requires accurate assessment of the local market and developer credibility.
Resale properties provide immediate rental income potential and transparent market valuations. Established areas like Mijas or Fuengirola offer proven rental yields of 4-6% annually for well-positioned properties.
Currency timing affects both routes differently. Off-plan buyers make staged payments over 18-36 months, allowing currency hedging strategies. Resale buyers face a single large transfer at completion, making exchange rate timing more critical.
